Make Money Online More than a dozen state attorneys general Monday sought to block the federal government from implementing a rule change they argued would lead to more air pollution from the nation's power plants.

The revised New Source Review rules were initially released in late August, while the agency was being run by the acting E.P.A. administrator, Marianne Horinko. Those rules will take effect in December in 12 states that do not administer these rules themselves. The 38 other states will have up to three years to decide whether to adopt the new rules. Last week, about a dozen states and cities filed suit in federal court to overturn the changes to the New Source Review program that the agency seeks to enact.

The Bush administration has asked a federal court to block an environmental group from questioning the former director of the White House's energy task force. In a filing in U.S. District Court in Washington, the Justice Department asked Thursday that the Natural Resources Defense Council be blocked from deposing Andrew Lundquist, who was the task force director before leaving the government. The administration asked that any such depositions be put off until the court rules on the validity of the environmental group's lawsuit. Robert McCallum, the assistant attorney general who filed the government's request, said the administration expects to file another motion May 23 arguing against the need for any such depositions.

Free Online Affiliate Program To win an injunction, the states must show they are likely to succeed at a full trial of the issues, and that irreparable harm would be done if the rule change was enacted even for a short period of time.

In its Mount Laurel decision, the Supreme Court called for sound planning and environmental protection in addition to housing opportunities, and there is a way that the state can achieve those goals through its affordable housing rules. Unfortunately, the state has proposed rules that will do just the opposite.
